The undersigned have taken notice of the legal confrontation between the 
Hamburg
Foundation for the Advancement of Science and Culture and Sebastian 
Lütgert, the
owner of the website textz.com, who has been accused of the illegal 
distribution
of two works by Theodor W. Adorno, of which the foundation holds the 
copyrights.

Even though we are not in a position to make a judgement on the damages 
that the
foundation has suffered through the distribution of these texts, we are
convinced that, in order to contain these damages, your willingness to debate
the issue at stake would be much more appropriate than a legal procedure.

It seems that in this particular case, a purely juridical argumentation may not
only disregard the intention of the works under your protection, but also
contradict the foundation's very aim to advance science and culture.

We kindly ask you to rethink your position on the issue, to permanently suspend
the warrant of arrest that the foundation has obtained against the defendant,
and to undertake the effort to seek a private settlement.

Die Unterzeichnenden haben Kenntnis genommen von der juristischen
Auseinandersetzung zwischen der Hamburger Stiftung zur Förderung von
Wissenschaft und Kultur und Sebastian Lütgert, dem Betreiber der Website
textz.com, dem die Stiftung die unerlaubte Verbreitung zweier Werke von Theodor
W. Adorno vorwirft, an denen sie die Rechte hält.

Die Schäden, die der Stiftung durch die Vervielfältigung der Texte entstanden
sind, können und wollen wir nicht beurteilen. Wir sind jedoch davon überzeugt,
dass diese Schäden sich durch eine inhaltliche Auseinandersetzung mit der
Angelegenheit weit eher begrenzen liessen als durch eine gerichtliche.

Der Rückzug auf eine rein juristische Argumentation scheint uns in diesem Fall
nicht nur der Intention der von Ihnen geschützten Werke zu widersprechen,
sondern auch dem Auftrag der Stiftung - der Förderung von Wissenschaft und
Kultur - nicht gerecht zu werden.

Wir möchten Sie daher bitten, ihre bisherige Haltung in dieser Sache zu
überdenken, den Haftbefehl, den die Stiftung zwischenzeitlich gegen den
Beklagten erwirkt hat, dauerhaft aussetzen zu lassen, und sich um eine
aussergerichtliche Einigung zu bemühen.
