Kerry did concede to early as Jessee Jackson said - he did even 
before the first official vote count was out. Now he wants to get 
back in the game. Hmmm, why is this not surprising from Kerry? The 
Ohio's vote was indeed counted the second time (i.e. Ukraine got the 
re-vote and Ohio got the re-count), as requested and paid for by the 
third party candidates (Greens and Libertarians), not by Kerry and 
DNC. Reportedly Bush was again declared a winner but with a smaller 
winning margin. Now the third party candidates (today) cited 
irregularities in the re-count (if those news could penetrate the 
tsunami coverage), and requested the SECOND recount, which Ohio's 
Secretary of State is not likely to entertain. The ball therefore is 
in Kerry's court and he is supposed to finally say (hopefully before 
the inauguration day) whether he ultimately accepts that he lost or 
not.

       If you haven't been following John Kerry closely, get ready to
       hear
of surprising developments. The vote-defrauded, potential
president-in-waiting has just indicated through his lawyer that the
validity of George Bush's reelection is no longer a given.
       On 23 December, 2004 Kerry's lawyer confirmed to MSNBC's
'Countdown' that John Kerry will be seeking (likely on Monday 27 
Dec.)
to expedite court proceedings and secure evidence in an ongoing
recount suit by the Green and Libertarian parties. That might sound
like just another "count every vote" exercise by the Kerry campaign,
were it not for two important details.
       Kerry's court filing will conjoin him to existing allegations
       that
Triad Systems, a Republican-linked supplier of voting machines to
around half of Ohio counties --"orchestrated" a covert campaign to
thwart a legitimate recount in Ohio. If the allegation proves well
founded, it could invalidate the Ohio recount and eventually even 
hand
the presidency to John Kerry. Which probably explains the second
critical detail: a quiet, on the record bombshell statement to
'Countdown' by Daniel Hoffheimer, the Cincinnati lawyer representing
the Kerry campaign in Ohio. Previously, the Kerry Campaign's intent 
in
Ohio seemed to be merely an exercise of American civic spiritedness.
       Two weeks ago, when Kerry wrote to Ohio's 88 county boards of
election asking to visually inspect some ballots, Donald McTigue, the
lawyer handling the recount for the Kerry campaign said: "We're 
trying
to increase the transparency of the election process."
        In early December, when the Kerry Campaign joined a suit by
        Green
and Libertarian party candidates seeking a recount in Delaware 
County,
Daniel Hoffheimer said Kerry wasn't disputing President Bush's 
victory
in Ohio. The aim was to make sure any recount was "done accurately 
and
completely," Hoffheimer said.
       That's the first time the Kerry Campaign has impugned the
legitimacy of Bush's reelection.
       It's a signal move, likely driven by emerging evidence of
suspicious activity by representatives of Triad Systems during the
recount in Ohio. Evidence which has led a senior Democrat, ranking
House Judiciary Cmtee. member, John Conyers Jr. to accuse Brett A.
Rapp, the boss of Triad Systems of orchestrating a criminal 
conspiracy
to pervert the outcome of the Ohio recount.
       The allegations first surfaced before an extraordinary Ohio
       hearing
convened by Conyers on behalf of Democratic Minority members of the
House Judiciary Committee. An affidavit filed by Sherole Eaton,
Hocking County deputy director of elections, stated that a Triad
representative had told her "how to post a 'cheat sheet' on the wall
so the ...count would come out perfect and we wouldn't have to do a
full hand recount of the county."
       That account has been corroborated by other officials and by
extracts from a video documentary in which a Triad technician admits
that the company was in possession of computer "backup" copies of the
official election data. If the recount was fraudulent, does that have
implications for the validity of the first count in Ohio? The Kerry
campaign knows full well that it does. That's why their latest
statement questions the "integrity" of the "entire" electoral 
process.
And the election of Bush/Cheney.
       For Kerry, a fraudulent recount in Ohio could be an open door
       into
to the Oval Office. Already, John Conyers is confident that a few 
U.S.
Senators will join House members on January 6 to question the 
November
2 election. On Thursday, the Chicago Tribune reported that in a
conference call with journalists Jesse Jackson said that Kerry had
conceded the presidential election "much too soon. Before all the
facts were in."
       But don't expect Kerry to quickly rush to a microphone in 
order
       to
unconcede. He doesn't have to. His unconcession will take effect by
default. If the Ohio recount is shown fraudulent, the domino effect
could carry him through that door without claiming victory or even
unconceding.
       Simply by allowing Bush's claim on the Office of President to
       fall
--piece by fraudulent piece. Nudging the dominoes to topple in the
right way. Thus leaving Kerry, poised to step into office over the

     2004 Democratic Presidential candidate John Kerry will file
     today,
in the United States District Court for the Southern District of 
Ohio,
papers in support of the Green Party/Libertarian Party recount 
effort.
Specifically, Kerry will be filing a request for expedited discovery
regarding Triad Systems voting machines, as well as a motion for a
preservation order to protect any and all discovery and preserve any
evidence on this matter.
     Triad Systems has come under scrutiny recently after Sherole
     Eaton,
deputy director of elections for Hocking County, swore out an
affidavit in which she described her witnessing the tampering of
electronic voting equipment by a Triad representative. Rep. John
Conyers, the ranking minority member of the House Judiciary 
Committee,
has requested an investigation into this matter by the FBI and the
Hocking County prosecutor.
     Truthout will have more on this specific Triad allegation later
     in
the day.
     Previously, the Green Party and Libertarian Party have not fared
well in their efforts to get emergency orders regarding this matter 
in
Ohio. In order to pass muster with a judge, the individual or group
requesting an emergency order for such a recount must show both
irreparable harm as well as a substantial chance for success on the
merits. While Green and Libertarian representatives could
theoretically be able to show irreparable harm, they could not
establish a substantial chance for success on the merits, because no
recount would deliver Ohio to either party.
      Kerry's entry into this recount effort changes the math on this
matter dramatically. He can likewise show irreparable harm, and 
unlike
the Green and Libertarian candidates, he can also prove a substantial
chance for success on the merits because he lost the Ohio vote by a
statistical whisker.
     It should be noted that Kerry's filing of these requests does 
not
indicate his complete entry into the recount process, but does 
clearly
indicate that he is moving decisively in that direction --------------

    TV Networks Officially Refuse to Release Exit Poll Raw Data

       For those watching the growing body of evidence concerning
       election
fraud in our past presidential election, one question has remained:
Why don't we hear about this on the evening news?
       It's hard to believe that the media would cover up something
       like
this, considering that many reporters probably voted for Kerry and
would want the people to know if the election was stolen. But there's
already enough of a story that it should be getting attention - the
Congressional hearings, lawsuits filed, and sworn testimony are
newsworthy of themselves, regardless of their outcomes. The lack of
coverage of already existing events forces us to wonder why.
       Attempts to get an explanation from the media have been met
       with
cold and evasive responses. No one has been able to explain why the
media is avoiding it like the plague.
       Yesterday Representative John Conyers called their bluff. He's
       the
one leading the investigation in the House of Representatives
Judiciary Committee. After weeks of investigation he's become more 
and
more interested in seeing the raw data of the exit polls. Exit polls
were a red flag in Ukraine, and many statistical experts have used 
the
exit polls from our election to demonstrate a high likelihood that
there was some funny business on November 2nd.
       Like most people trying to get to the bottom of the matter, 
Mr.
Conyers first came to the realization that the exit poll data has
mysteriously not been released yet. We only have the preliminary exit
poll data, which showed Kerry winning Ohio by several points. But
about half way through election day, the networks started "mixing in"
the "real" numbers with the exit poll data, and from that point on,
the raw exit poll data has been locked up.
       So, Conyers wrote to Warren Mitofsky, who owns the exit poll
       data,
asking for the complete raw data, without the "real" numbers mixed 
in.
Mitofsky balked, saying that the TV Networks actually own it and he
was not able to release it without their permission. Conyers then 
took
his inquiry to the leaders of ABC, CBS, NBC, CNN, and Fox.
       And they promptly laid an egg. Through a spokesperson who 
spoke
       on
behalf of all the media companies together, they said they are still
analyzing the data and don't want to release it until they're done.
       The egg they laid is frustrating for those who want to know 
the
truth and want to see the raw exit poll numbers. But it does answer
one question for us once and for all. It finally shows us that the
media is not avoiding the election controversy because they're tired
of the election, or they want more evidence. They are purposefully
preventing the information from getting out and they are hiding the
information they have.
       Any objective investigator, or any concerned citizen for that
matter, simply cannot accept their answer to Conyers. The media has
had over 6 weeks to "analyze" the exit polls and releasing the 
numbers
would not prevent them from continuing their analysis in any way.
        The data is just that - raw data. By itself it is not 
obscured
        by
"analysis." The networks can evaluate and analyze it all they want,
but they should also give others a chance to look at the same numbers
and draw their own conclusions. There is absolutely no precedent or
moral ground for withholding this information from the American
public. The bottom line is that raw data does not need to be 
analyzed.
Conyers and the American people are not asking for the analysis. 
We're
asking for the data.
       We're not talking about proprietary trade secrets, or a 
"secret
source" that they're trying to protect. We're talking about
information about us, the American people who voted on Election Day.
It's like having your doctor refuse to let you see your own medical
records.
       Their refusal to release the exit polls shows us categorically
       that
there is a concerted effort on behalf of the major media outlets to
consciously prevent the information from getting out. It's not simple
oversight, and it's not because they don't think it's newsworthy. Now
we know. They are withholding information from us. Now that that's
been resolved, we can move on to the next question: What are they
hiding, and why?
